In short. This is a free tool that reads the public comments of a public TikTok video and picks winners at random. It is not affiliated with TikTok or ByteDance. We give no guarantee about completeness, accuracy or availability. You run your giveaway and you are responsible for it being lawful.
1. Who we are and what you accept
The TikTok Comment Picker (the "Tool") is offered free of charge by Giveaway Ninja ("we", "us"), the operator of giveaway.ninja. By ticking the acceptance box, or by using the Tool, you agree to these Terms of Use, to our Terms of Service and to our Privacy Policy. If you use the Tool on behalf of a company, you confirm that you are allowed to bind that company. If you do not agree, do not use the Tool. You must be at least 18 years old, or the age of legal majority where you live, whichever is higher.
2. Not affiliated with TikTok or ByteDance
The Tool is not sponsored, endorsed, administered by or associated with TikTok, ByteDance Ltd. or any of their affiliates. TikTok is a trademark of ByteDance Ltd. and is used here only to describe what the Tool works with. We have no special access to TikTok. The Tool reads information that is publicly visible on TikTok through third-party data providers, and TikTok can change, limit or block that access at any time without notice. If that happens, the Tool may return fewer comments, no comments, or stop working.
3. What the Tool does, and what it cannot promise
- It reads publicly visible comments of one public TikTok video or photo post and shows them to you.
- It applies the rules you choose (tagged friends, hashtags, replies, repeated comments, excluded accounts) and selects winners at random using your browser's cryptographically secure random number generator. We do not influence who wins.
- The number of comments we can read may be lower than the number TikTok shows. Comments that are hidden, deleted, restricted, filtered as spam, posted by private accounts, or above our per-video limit are not available to us. Where we can, we tell you how many comments are missing and why.
- Results depend on the data available at the moment you use the Tool and may not be reproducible later. A draw is a random selection among the comments we could read, not a certification of the outcome of your giveaway.
- The Tool is provided as is. We give no guarantee that it will be available, error free, complete or accurate, or that it fits your needs or the rules of your giveaway.
4. Your giveaway, your responsibility
You are the promoter of your giveaway. We are not a party to it, we do not administer it and we do not deliver prizes. You alone are responsible for:
- Running it lawfully where you and your entrants are located, including sweepstakes, lottery, gambling, consumer protection, advertising and tax laws; any registration, bonding or approval a jurisdiction may require; and the terms you offer, such as official rules, eligibility (age, residency), start and end dates, prize description, odds where required, and how winners are notified.
- Complying with TikTok's Terms of Service, Community Guidelines, Branded Content Policy and Promotions Policy. TikTok requires that a promotion run on its platform is compliant with applicable law, that entrants are told the promotion is in no way sponsored, endorsed or administered by, or associated with, TikTok, and that the promoter alone is responsible for it. TikTok does not assist in administering promotions and you run them at your own risk. Do not ask people to engage inauthentically, for example to create multiple accounts to enter more than once.
- Using the Tool only for videos you own or manage, or on which you are authorised to run a giveaway.
- Honouring the rules you announced. The Tool helps you apply them; it cannot know what you promised.
- Contacting winners and handling their data lawfully. Use the information the Tool shows you only to run and document this giveaway. Do not use it to build lists, profile people, send unsolicited messages or for any other purpose.
- Keeping your own evidence of the draw, for example the draw record or the reveal video you can download, if you need to prove how the winners were picked.
Nothing in the Tool is legal advice. If you run giveaways with high value prizes, in regulated industries, or across several countries, ask a qualified lawyer.
5. Acceptable use
Do not use the Tool to harass, stalk, discriminate against or harm anyone; through automated means, bulk requests or in ways that bypass the reCAPTCHA or our limits; to resell it or offer it as your own; or in any way that breaks the law or the rights of others. We may limit, suspend or block use of the Tool at any time, for any reason, without notice.
6. Data we process
To run the Tool we process:
- The link you paste, the details of the video (creator handle and name, caption, cover image, like and comment counts) and its public comments (username, display name, profile picture link, comment text, time, likes, whether it is a reply).
- Your IP address, browser information and the time of the request, to prevent abuse, apply rate limits and fix errors, together with your acceptance of these terms.
- The rules you set and the result of the draw, if you run one.
We use third-party providers to read public TikTok data (currently Apify) and Google reCAPTCHA to stop bots. Our servers are hosted on Amazon Web Services. We keep each request so that you can return to the same video for a short time, so that we can spot abuse, measure costs and improve the Tool, within the retention periods described in our Privacy Policy. We do not sell this data. People who appear in the comments can ask us to remove their data from our records at hello@giveaway.ninja. Our Privacy Policy explains your rights and how to exercise them.
7. Costs
The Tool is free. We may change, limit or withdraw it, or start charging for it, at any time.
8. No warranty
The Tool and its results are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness, availability and non-infringement. We do not warrant that every comment will be read, that the Tool will be uninterrupted or error free, or that its results will be accepted by any authority, platform or person.
9. Limitation of liability
To the fullest extent permitted by law, we, our officers, employees, suppliers and affiliates are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or reputation, arising from or related to the Tool, its results or your giveaway, including disputes with entrants, missing or inaccurate comments, draws that have to be repeated, or actions taken by TikTok or ByteDance against your account. Our total liability for all claims related to the Tool is limited to one hundred euros (EUR 100).
Some laws do not allow some of these limits. In that case they apply to the extent permitted, and nothing in these terms removes rights that consumers have under mandatory law.
10. Indemnity
You will defend, indemnify and hold us harmless from claims, damages, fines and costs, including reasonable legal fees, arising from your giveaway, your breach of these terms or of the law, or your use of the information the Tool shows you.
11. Changes
We may update these terms. The version and effective date are shown at the top. Using the Tool after a change means you accept the new terms.
12. Governing law
These terms are governed by the laws of Italy and the courts of Italy have jurisdiction, without prejudice to mandatory consumer protection rules and to the competent courts of your country of residence where the law gives you that right. The Giveaway Ninja Terms of Service apply to anything not covered here. Where the two conflict, these Terms of Use prevail for the Tool.
